Matt allowed my oldest sister to rewrite my Mother's will and This was done online and over the phone with very little input from my mother. Sure there were some valid ideas and the goal should always be to protect assets. However My mother only met Matt in person when she was in his office the day of the signing. My Mother also only first had a chance to see the Will at that very moment with 4 people standing over her. Sure my sister was asked to leave the room for a while and sure the will was available to read online the entire time. That said; Matt should be more versed in family dynamics including the frequency of domestic abuse on elders in family settings. Red flags should also sound over the scapegoating of family members for personal gain and power.

Andrea, since you are not a client of this firm and we have had no direct dealings, I cannot comment on your situation specifically. However, we often deal with difficult family dynamics and it is not our role to judge a person’s personal wishes. That said, whenever a senior is making changes to their estate plan we make sure to assess competency, make drafts available for review well before execution and meet one-on-one with the person signing to discuss their personal goals and wishes, as you note in your review. Legally, no one is guaranteed an inheritance, and, lacking clear incapacity, a person is free to make their own decisions as well as to change their mind. If you don’t think the current plan reflects your mother’s true intentions I suggest speaking with her directly.

Everyone we met at the Heritage Law Center was friendly and very helpful, Matt Karr listened to what our needs were for estate planning and asked questions we had not thought of.
