Angie, we've discussed this repeatedly, but I think it's important that information included here is accurate. I take my reputation with my clients very seriously. People's feedback matters and if I do a poor job, I expect to be called out. However, that is not the case here. Due to attorney-client privilege, I'm limited in what details I can include, but everything I will say is public record. You never raised a concern about my representation until I told you that your case would get dismissed and there wasn't anything I could do to stop that dismissal. This was your fourth bankruptcy in the last five years (the first one with our firm). You knew the rules when you filed for bankruptcy. I was able to get your dismissal continued out four or five different times. The judge even said at the dismissal hearing, which you didn't attend, that I get an "A for effort" in trying to save your case. If you don't make your payments, you can't stay in a Chapter 13 bankruptcy. You didn't make the payments. We told you we couldn't guarantee you would be able to keep your house due to there being no automatic stay due to numerous previous cases you filed. I'm very confident that if I had "guaranteed" that we were going to be able to keep your house and then we were the cause of you losing your house, as you suggest, you would not have continued to employ me as your attorney for almost an entire year before your case was ultimately dismissed. You were in your bankruptcy for 11 months. During that time, you paid fewer than five months, on time. You are correct, a portion of your payments are paid to us and the Trustee's office while in a Chapter 13 bankruptcy. You were aware of this entering the bankruptcy where we have a signed contract explaining that. If I wasn't paid in your Plan, I would have to charge you a significant amount up front to pay for the standard attorney fees. To avoid doing that, we charge a small amount up front, and the rest gets paid from your monthly payments to the Chapter 13 Trustee. Again, to my knowledge, this is how every attorney and Trustee nationwide is paid in a Chapter 13 bankruptcy. If the money were not going to us, it would be going to credit cards, personal loans, and medical bills that would, otherwise, not have to be paid back. I'm not sure what you are talking about when you say you aren't getting the full story from us. I've told you repeatedly, in writing, that if you don't make your Chapter 13 payments, your case will get kicked out and that's what happened in your case. The Trustee, the Bankruptcy Administrator's office, and the Court all commented about how many cases you had been in, how you are familiar with the bankruptcy rules, and that not making the payments were grounds for a dismissal. Until I told you that your case would get dismissed, I had not heard anything from you for the eight months prior except two emails about you making plan payments. I responded to both of those emails to your satisfaction. All of this to say, I hate that your case got dismissed. I want(ed) you to succeed. However, to be successful, you have to follow the laws, which you are familiar with. Although you were unsatisfied with my service, I wish you and your family the best moving forward.
