Poor handling of financial disclosure and due diligence due diligence caused issues
During my financial remedy proceedings, I had significant concerns about the approach taken regarding the respondent's financial disclosure. A claim about a debt being 'written off' through insolvency was central to the outcome but was not properly investigated or verified. This lack of due diligence resulted in a financial order that, in my opinion, relied on material non-disclosure. I am now forced to apply to set aside the order due to these failings. If dealing with complex financial matters, I strongly recommend ensuring claims of insolvency or debt discharge are independently verified.
